TERMS OF SERVICE

These Terms of Service (“Terms”) apply to purchases made through MOANA (“we”, “us”, “our”) via https://moanabikini.com (the “Site”). By placing an order, you agree to these Terms along with our Privacy Policy, Shipping Policy, and Returns Policy (together, the “Policies”).

1) Orders, Cancellations & Out-of-Stock Items

We reserve the right to review, accept or cancel any order at any time before it has been processed.

Out of stock / unable to fulfil

If an item you purchased becomes unavailable before packing, we will contact you via email.

Where possible, we may offer an alternative resolution (for example: store credit, or a style/size swap). If we request additional details from you and you do not respond within a reasonable timeframe, your order may be cancelled and refunded.

If we cannot offer an alternative:

  • we will refund the value paid for the unavailable item, and

  • we will dispatch the remainder of the order as normal.

Important: If your original order qualified for gifts, in-cart rewards, or other benefits based on minimum spend, you will still receive those benefits based on your original qualifying spend.

Limitation

You will not be entitled to claim any additional compensation for loss, expense, damage, inconvenience or time resulting from a cancellation or refund.

If you choose to cancel your entire order due to an out-of-stock item, you may be entitled to:

  • a refund for the out-of-stock item, and

  • store credit for the remainder (where applicable), in line with our Shipping Policy.


2) Incorrect, Faulty or Missing Products

If your order arrives with an incorrect item, a faulty item, or a missing item, contact us at info@moanabikini.com with:

  • your order number, and

  • a clear photo of the issue (or the name of the missing item)

We’ll investigate and take reasonable steps to resolve the issue.


3) Returns

Returns, exchanges and refunds are governed by our Returns Policy.

Final Sale items are not eligible for return or exchange, except where required by law.


4) Promotions

Discount codes

  • Only one discount code may be applied per order.

  • Discount codes must be applied at checkout and cannot be added after the order is placed.

  • Unless stated otherwise, discount codes are limited to one use per customer.

  • Discount codes may be used with a gift card/store credit, but not with another discount code.

  • We reserve the right to cancel orders where a customer attempts to use a discount code multiple times through different accounts (“double-dipping”).

Discount codes are not returnable. If you return items purchased using a discount code, you are not reimbursed the value of the discount and you may not be able to reuse the code (unless the code allows multiple uses).

Final Sale threshold (10%+)

Any item discounted by more than 10% is treated as Final Sale and not eligible for return or exchange (except where required by law).
This includes discounts applied via codes and/or combined reductions where the total discount exceeds 10%.


5) Instagram Competitions & Giveaways

Winners will be notified via Instagram direct message. If a prize includes physical products, we may ask the winner to confirm details via email and may offer sizing advice if requested.

If an item pictured or referenced in a giveaway is unavailable at the time of winner selection, the winner will be offered:

  • a replacement item of equal value, or

  • store credit.

If a winner receives the wrong size, they may exchange for a different size (not a different style) by emailing us within two (2) weeks of delivery. Return shipping for exchanges is the winner’s responsibility.

Giveaway prizes are final and cannot be exchanged for a different style or refunded for store credit.

Scam warning

We will only contact winners from our official account(s). We will never request bank, password, or credit card details via social media. We are not responsible for loss or damage caused by third parties impersonating us.

6) Free / Gifted Items

From time to time, we may include free or gifted items as part of a promotion (including BOGO offers) or as a goodwill gesture.

Free/gifted items are:

  • not eligible for return or exchange, and

  • not redeemable for cash or store credit.

You do not need to return free/gifted items in order to return purchased items that are eligible under our Returns Policy.


7) In-Cart Rewards

We may offer in-cart rewards tied to a minimum spend.

  • Rewards must be unlocked and added within the cart once the minimum spend is met.

  • Minimum spend must be met in one single order (not across multiple orders).

  • If the reward is not added in the cart before checkout, it will not be included and is forfeited.

If you notice a reward missing from your order confirmation, contact us ASAP. Rewards cannot be added once an order has been processed and cannot be held for a future order.

In-cart rewards are not returnable, exchangeable, or swappable prior to shipping. If there’s an issue with a reward, contact us at info@moanabikini.com and we’ll help.


8) Free Shipping Promotions

If “Free Shipping” is offered, it applies to shipping methods other than International Priority (DHL) unless stated otherwise.

Customers must still select their shipping method at checkout. Free Shipping does not automatically select Express.

For security or operational reasons, we may upgrade shipping on an order at our discretion. A one-off upgrade does not create an ongoing entitlement.


9) Discounted Products, Sale Pages & Price Changes

We may discount products at our discretion, including via:

  • sale pricing

  • promotional pages (e.g. “Black Friday” style collections)

  • limited-time promotions

Products discounted by more than 10% are Final Sale (subject to our Returns Policy and any rights under law).

We may start or end promotions at any time without notice. If we publish a promotion end time (“Last Chance”), the promotion will be honoured until that time.

All stated dates/times are AEST unless otherwise stated.

As prices change over time, you may purchase an item that later goes on sale, or purchase on sale before it is further reduced. We do not provide refunds, credits, compensation, or cancellations due to price changes after purchase.


10) Pricing & Currency

Prices are shown in the currency displayed on the Site (for example AUD or USD depending on your region/storefront settings).

For international purchases, conversions may be provided via integrated currency tools. Your final bank conversion rate may differ depending on your provider.

We may update prices on the Site at any time without notice.


11) Security

We use industry-standard security measures to protect your information, including SSL encryption for data transmission. We do not store full credit card details.


12) Electronic Communications & Marketing Consent

By placing an order or providing your contact details, you agree we may send you transactional communications (order confirmations, shipping updates, account and service messages).

Where you have consented (or where permitted by law), we may also send marketing communications about products, promotions and updates. You can unsubscribe at any time using the link in our messages or by contacting info@moanabikini.com


13) SMS / Mobile Message Terms

If you opt into our SMS marketing, your participation is governed by our Mobile Message Program Terms (including opt-in/opt-out instructions, message frequency, and carrier charges). Message and data rates may apply.

To opt out, reply STOP (or equivalent keywords described in the program terms).

We respect your privacy — please refer to our Privacy Policy for how personal information is collected and used.


14) Australian Consumer Law (ACL)

Nothing in these Terms limits or excludes your rights under the Australian Consumer Law. Where you are entitled to a remedy under ACL, those rights apply.
